Divorce in Islam  Mar 7, 2018 The teachings of Islamic law and the Qur'an are very clear about divorce: a couple should not remain together if they are unable to live in harmony, or if one or both of them has been unfaithful. This, however, does not mean that there is no way for a couple to obtain a divorce. They must ask for the divorce, in an orderly way, and only after both have given their consent. The Qur'an states: "The divorced woman (must not) wait (the period) of three months, nor should she hide herself. But if she is pregnant, she should keep herself in seclusion for three months. And the man must not take (other) wives during this period" (Quran 4:128). Islam does not condone child abuse, and the Qur'an says that the abusive parent must face the consequences, while the child should be taken care of. "If you divorce the women, (remember) to make (equal) settlements for her for what you have given her, if you think her to be too poor, and provide her with the means to live; this is the manner of good conduct in marriage" (Quran 2:228). Islam teaches that the divorced woman should be taken care of financially, so that she does not have to rely on the kindness of others. The Qur'an also commands the man to provide for the woman he divorces financially. "If you divorce the women, (remember) to make (equal) settlements for her for what you have given her, if you think her to be too poor, and provide her with the means to live; this is the manner of good conduct in marriage" (Quran 2:228). He should also give her a divorce deed or a khula to sign, stating that she has been divorced, if he wants to be sure that she will not remarry him. According to Islamic law, the man is not allowed to remarry the divorced woman until her financial needs are taken care of, and the issue of a khula or divorce deed is final and valid. "If he divorced her in the fault of the woman, he should not seek to get her back, except in the case of compulsion, for the purposes of justice; and the release should be made clear in the presence of two witnesses" (Quran 2:229).
